Haunted houses, in addition, are hauntingly and eerily attractive.</p>

<p><strong>Timeshare Miss-selling and the 1994 Timeshare Directive</strong></p>
<p>It has been widely reported in UK press and media that Timeshare miss-selling practices in its home countries is now under intense scrutiny from Government bodies including the Office of Fair Trading, and with the recent jailing of two co-conspirators who ran a timeshare miss-selling scam out of Graig Park village Wales, this now seems to be the case in the UK. The UK has taken timeshare directive powers and has pursued these law breakers (only UK companies) to the full extent of the law.</p>
<p>However what about Europe, there are over 1.5 million European owners of timeshare, on some 1,312 Resorts, and with timeshare and holiday club complaints at an all time high, it is no wonder that timeshare forum sites are growing by the day of disgruntled timeshare owners expressing their views on this relevant topic. This miss-selling is not as some may think an itemised case of just 1 or 2 unscrupulous timeshare developers trying to earn a quick buck, but a scale that could put the European timeshare market on its back, only you the timeshare owner will know if you have been miss-sold, as no developer past or present will keep logged accounts of how they used to do business. If on the other hand you believe the industries statistics on happy owners, then 85% of you should not read on, if you do read on then look at the 1994 timeshare directive and the three key areas, then ask yourself was I miss-sold.</p>
<p>Miss-selling has occurred in many shapes and forms in most industries but seems to have evolved in timeshare sales in Europe since 1994, when as then unknown to most prospective timeshare purchasers a timeshare directive was drawn up and implemented on by the European union, this included amongst others three main key areas:</p>
<p>Giving purchasers the right to information in a prospectus before signing a contract and requirements for the content of the contract.</p>
<p>Once the contract is signed, the consumer has a cooling-off period of at least 10 days, during which he can withdraw from the contract without giving any reason;</p>
<p>A ban on advance payments throughout the cooling-off period</p>
<p>Under these terms:</p>
<p>Any purchaser that did not receive a prospectus (apartment inventory, constitution ect) when signing has been miss-sold.</p>
<p>Any purchaser that did not receive a minimum 10 day cooling off period, when they signed has been miss-sold.</p>
<p>Any purchaser that paid a deposit during their cooling off period has been miss-sold.</p>
<p>These rules were and still are being flouted, under these terms the miss-sold timeshare owner can pursue for a full refund, even if that company is no longer trading, saying this and succeeding are two entirely different things.</p>
<p>There is light at the end of the tunnel for some, whether they take this action up with their own lawyer (must be proficient on timeshare law and the country that they purchased in) or as quoted in a new media campaign by a company in Gran Canaria, they will take these cases on a No Win, No Fee basis. However they only deal with Timeshare miss-selling that has occurred in Spain or its territories after 1994.</p>
<p>I am sure over the coming months/years there will be lawyers who will jump on the bandwagon of this vastly flouted law, whether it breaks the timeshare industry or not will be another story.</p>

			<content:encoded><![CDATA[<p><strong>Vacation In The Best Resorts For Free With Timeshare Exchange</strong></p>
<p>Last weekend, I was showing some friends the photos of our trip to Spain, where we spent 10 days in Madrid and on the coast in Marbella. Photo after photo, we marveled at the beauty of the art and the landscape. It was so wonderful, and the photos just didn&#8217;t do it justice. My friend Chris also wanted to know more about our accommodations: a two-bedroom villa with marble floors, full kitchen with granite counters, king-size bed, and Jacuzzi tub. Since the trip, I hadn&#8217;t thought about the villa and how gorgeous it was, mostly because we&#8217;ve become accustomed to vacationing like that. We stay in the best places, and it doesn&#8217;t cost us very much to do it. What really confused him was that he knows how much money I make (certainly not enough to afford a place like that), and that I have kids too. Chris and his wife wanted to know how I pulled it off. </p>
<p>I told him that although Lynn and I love to vacation, we never want to worry about our safety or the cleanliness and quality of our lodging. We won&#8217;t budge on that. But we also have a budget that we have to manage very closely. And with the economy the way it is, it&#8217;s even more important to watch our spending. Lastly, we don&#8217;t like the &#8220;hidden fees&#8221; of travel that are tacked on every time you turn around these days. I told him that we use a technique that is available to everyone, but that is used by few people since many don&#8217;t understand it. It&#8217;s called timeshare exchange, and it&#8217;s actually quite simple. Let me explain how it works.</p>
<p><strong>Resort Timeshare Exchange</strong><br />We purchased our timeshare in Hawaii years ago. As nice as that resort is, we don&#8217;t want to go there every year—we want to see new places. And as timeshare owners, we have the right to trade our unit with another owner. So we trade our week for their week, and they get to vacation at our place and we vacation at theirs. It&#8217;s kind of like swapping homes for a week, except these are gorgeous resorts in the best vacation areas. We always know the quality of the resort because we know people that have stayed there. And besides the annual cost to maintain our own place, with our method it never costs us a dime: no fees, no hidden fees, no taxes, nothing. </p>
<p>The fact that we don&#8217;t pay any fees surprises many people, since most timeshare exchanges today are handled by two companies that do charge fees. RCI is the largest, and Interval International is the other. As a member of their service, you pay an annual membership fee of about 0 each year, even in years you don&#8217;t trade. You also pay an exchange fee of 9–199 each time you trade. When you are ready to trade, you &#8220;deposit&#8221; your timeshare week into their &#8220;bank,&#8221; and then you get to &#8220;withdraw&#8221; a week at a property that they deem to be of equal value. </p>
<p><strong>Avoid the fees</strong><br />Chris told me that his parents own two timeshares—one in Aruba and one in Orlando. &#8220;My parents are always complaining about all the fees. So how do you do it for free?&#8221; Chris asked. It&#8217;s simple: We don&#8217;t use RCI or Interval International. We trade on our own. We&#8217;ve been traveling for years and created a network of timeshare owners that all want to trade timeshares but don&#8217;t want to pay all those fees. So each year we arrange our own trades. As the network got bigger, we created a website called TimeshareJuice. It links up timeshare owners around the world (some resorts have joined too) to enable them to trade for free. It&#8217;s easy and fun. </p>
<p><strong>Brief History of Timeshare and Vacation Ownership</strong><br />Today there are over 5,000 resorts in 100 countries, and over 6.5 million timeshare owners around the world. The industry has been around for over 40 years and admittedly has a dicey past. The timeshare industry is a provocative one, evoking images of unrelenting sales pitches, false promises, and lots and lots of hidden fees. But as my mom would always say, there are two sides to every story. Yes, even timeshare has another side. About 25 years ago, major hotel chains saw the potential of the business and began developing timeshare resorts called vacation clubs. The first prominent chain to jump in was Marriott, followed by Hilton, Hyatt, Disney, and others. Marriott <a rel="nofollow" onclick="javascript:_gaq.push(['_trackPageview', '/outgoing/article_exit_link']);" href="http://www.timesharejuice.com/resorts.php">Vacation Club</a> invested heavily and was determined to bring prestige to the industry. They use the term &#8220;vacation ownership&#8221; or &#8220;vacation club ownership&#8221; instead of &#8220;timeshare&#8221; to distinguish themselves from the rest. </p>
<p><strong>Vacation on a budget</strong><br />Using TimeshareJuice, the only costs we have are the annual maintenance fees (similar to condo fees) for our unit in Hawaii. Each place we stay in is already paid for by the other party. All we have to do is check in and start having fun. The resorts handle the check-in and check-out, maid service, maintenance, and so on, just like a hotel, so there&#8217;s nothing else to do. </p>
<p><strong>The Juice of Life</strong><br />Timeshare exchange has allowed us to sip wine as we gaze at the Mediterranean Sea from the beach in Marbella, Spain, watch the marvelous sunset from the sands of Maui, get pampered at a world-class spa in Palm Desert, and so much more. The juice of life is spending time with family and friends, having fun. We work hard all year and cherish our vacation time with our family. And when we do vacation, we want to make sure it&#8217;s the best value for our money. Vacation ownership and the ability to exchange have allowed us to have it all.</p>

<p>We love a great family vacation but we can&#8217;t afford vacation ownership or purchasing a timeshare. As a family we enoy two good vacations annually but as our family continued to grow in size it became increasingly difficult to find places that could comfortably accommodate our family. When our family grew to 6, we found ourselves resorting to listening to timeshare sales pitches in order to be able to stay at the really nice resorts for an affordable price. We didn&#8217;t have any idea that there was a timeshare-alternative available.</p>
<p>After doing this a few times we started to actually think that maybe a timeshare was something we should purchase. Who wouldn&#8217;t want to stay at a really nice family resort in Orlando, Gatlinburg, Hawaii or any other luxurious destination around the world. For example, the typical 2 bedroom resort is spacious enough for my family of six to really relax and really enjoy the living space. I am willing to bet that these resort timeshares are nicer than how the average family currently lives. The last place we stayed in had real wood kitchen cabinets, granite kitchen counters, genuine leather furniture, plasma televisions in every room, real burning fireplace and an indoor Jacuzzi that could fit 4 adults comfortably. It is truly a luxurious experience that has created some incredible memories for my family. It is an under statement to say, you will not want to vacation any other way! <p>Belive it or not, I truly felt guilty that we were staying at such a great resort. After all, we were really getting to enjoy how the people with a lot of money get to vacation without having to pay the high cost. However, my guilt only lasted up until the that we had to listen to the vacation ownership sales presentation. Then everything drastically changed.. You see there is an actually price you pay that costs more than money and that we had to pay that made me wish we had the money to buy a timeshare so that I could avoid what I called the timeshare torture chamber.</p>
<p>I know what you might be saying, how bad could&#8217;ve been but in my opinion it completely stunk. There is no other way to phrase it. We had to listen to a very skilled timeshare salesman pressure us into buying their &#8220;cheap&#8221; vacation pacakge. The conversation often went something like this, &#8220;Consider this sir, for only 28,000 dollars you are buying a lifetime of vacations for you and your family. Oh, and don&#8217;t let the 28,000 dollars scare you, we offer financing that will reduce that price to only a few hundred dollars a month for seven years.&#8221; The barrage continued throughout my courteous &#8220;I&#8217;m sorry but it is still too expensive&#8221; and after the 9th time of me telling them that we really weren&#8217;t interested but still having to hear about other specials and one time only manager &#8220;get away packages&#8221;, me and my wife made a promise to ourselves that we would never subject our family to another &#8220;relentless timeshare sales tatic&#8221; again. I am not kidding when I tell you that it was rude experience! When we finally said no to every timeshare package the nice tone discontinued and we were asked to leave.</p>
<p>We thought our only option would be to take purchase multiple no frill hotel rooms and try to get adjoining rooms. We are glad that we didn&#8217;t give up on our dream to luxurious vacations without having to spend a fortune.</p>
<p>So, I started searching for a timeshare alternatives. I immediately discovered that that a lot of people who purchased these types of vacation packages for 20-30K were trying to sell their timeshares for a fraction of the cost. We almost purchased a timeshare through this method. The deal sounded really good and then I noticed that there were many people trying to sell their vacation ownership package on the internet. This made me question why so many people were dumping their timeshares for 50% or more of what they paid for them or upwards of 80% of what a new timeshare purchase was being sold for. So, I decided to continue to investigate for a better timeshare-alternative.</p>
<p>I am glad that I did my &#8220;timeshare scams&#8221; research. My research exposed legitimate options when looking for a lifetime vacation option.</p>
<p>Here are my findings and your current options:</p>
<p>You can either purchase a new timeshare at a very inflated price and a really expensive annual maintenance fee. You will then have to become familiar with vacation ownership terms like points, RCI, red week, interval international, exchange rates. I wasn&#8217;t interested in learning this new language.</p>
<p>You can purchase a vacation ownership from someone who is trying to dump their timeshare and hope that the company that owns the timeshare &#8220;allows&#8221; the sale to go through because they often have the right of first refusal. Plus, if you get pass that hurdle you will have to still pay a high maintenance fee and make sure that the timeshare &#8220;points&#8221; mean the same today as they did when the person who is trying to sell actually purchased the timeshare.</p>
<p>You can just forget about timeshares or other types of vacation ownership all together and simply pay premium prices for these resorts which can cost several hundred dollars a night. Just go to Orbitz, travelocity, expedia or other agencies and see for yourself what a 2 bedroom suite cost in a exclusive resort destination. This wasn&#8217;t an option for us either.</p>
<p>You can bargain shop on the popular online travel outlets and hope the you negotiate a good deal that works with your travel/vacation plans and only pay a few hundred dollars a night instead of several hundred. I found that all I did was search and search and was simply settling for less.</p>
<p>You can use the same timeshare solution that we found. We paid a one time fee and now have access to thousands of the same timeshare destinations and can stay in those resorts for less than the cost of the timeshare maintenance fee we were quoted. No worries about learning a new language in the vacation club society.</p>
<p>I don&#8217;t want this article to seem like a sales pitch, so make sure to do your own research about the best timeshare-alternative option. If you are looking for a vacation ownership realize that there is an alternative to the traditional timeshare. Don&#8217;t get pressured into buying a timeshare. If you do, realize that you have a rescission grace period that will give you an option to cancel the purchase without penalties.</p>
<p>We were certainly happy and excited about our decision and I am extremely confident that you will feel the same way.</p>
