<p>The multiple ownership of individual weeks brought with it the guarantee of reservations for those who wanted to ski in the area. It was an immediate success. By the 1970&#8242;s some faltering condominium projects in St. Thomas, Fort Lauderdale and Puerto Rico were converted over to vacation ownership and thereafter timesharing became a viable vacation alternative.</p>
<p>Once the United States embraced the concept of vacation ownership it began to gain wide acceptance by the public. Sales jumped to over 50 million by the mid 1970&#8242;s and has climbed to more than 2 billion annually today. Vacation ownership has enjoyed substantial growth over the years with approximately 3.3 million timeshares sold since 1980. Currently there are over 5,000-vacation ownership resorts in over 75 countries around the world.</p>
<p>Exchanging a vacation ownership week in one resort for that of another resort was introduced in 1974 and thereafter timesharing offered variety and flexibility in the vacation experience. Although there are many exchange companies available, which provide excellent service, the two major forces are Resort Condominiums International (RCI) which has approximately 3,250 member resorts and Interval International (II) with approximately 1,600 member resorts. Combined, these two companies provided over 1,600,000 exchanges last year.</p>
<p>During a 30 year span, the industry has grown from small (15-20 unit ) hotel conversions to the high quality condominium resorts of today. The evolution of the industry from scattered entrepreneurs to well managed professional development companies has brought with it a noticeable change for the better. Definitive leaders have emerged and created standards and ethics for management, marketing and sales practices. One such organization is the American Resort Development Association (ARDA) who&#8217;s members are required to comply with the established &#8220;Code of Ethics.&#8221; The recent entrance into the marketplace by major hospitality chains such as Disney, Hilton, Ramada, and Marriott has greatly enhanced the quality and image of the industry. Vacation ownership resorts of today are luxurious, spacious and well located.</p>
<p>By the advent of these stronger and more professional development and management companies along with the weeding out the less desirable developers and marketers, the industry is experiencing a noticeable swing from a historically negative to a very positive public image. One of the industries&#8217;s leading analysts (Ragatz and Associates) concluded that the majority of timeshare owners are very satisfied with their purchase and in fact, many own multiple weeks. The future of vacation ownership is very optimistic and has tremendous potential.</p>
<p>What Is Vacation Ownership? </p>
<p>Vacation Ownership &#8220;Timesharing&#8221; is the right to use specific weeks of a resort during a specific time period. Simply put, it is the pre-purchase of a vacation. It is important to understand that vacation ownership is a commodity, which is purchased to be enjoyed and used over the years. One should never purchase a timeshare with the intent of reselling it for a profit. Vacations are holidays for which we spend money to relax and rejuvenate; they are not investments.</p>
<p>Ownership of a timeshare is very similar to ownership of a condominium except that your rights are limited to a certain week during the year. The form of ownership can be Deeded, Leased or a License.</p>
<p>The License is somewhat different in that it is most commonly a membership in a club. Providing you are a member in good standing, you have the right to use the club and all it&#8217;s amenities. Be sure to read and understand all the terms and conditions of your club membership before you make the decision to buy. Most vacation ownership consists of either a deeded interest or a leased interest for a specific number of years.</p>
<p>A Deeded interest is owned outright forever. It an absolute right, which can be sold, leased, or even willed to your heirs. Most timeshares, which exist today, are deeded ownership.</p>
<p>The Leased interest is much like an apartment lease except right to use it is restricted to a specific week during the year. Upon the expiration of the lease term your right to use will generally terminate and return to the resort. With a leased interest you should know the terms and conditions of the lease prior to making the decision to buy.</p>
<p>The time of your use can be either Fixed or Floating. Fixed time is a specific week during the year usually defined by a number. Generally the week will begin on a Friday, Saturday or Sunday and is given a number starting with the first week in January an run through the end of December. (Example &#8211; week 14 might be April 7 through April 13.)</p>
<p>Floating time means you have the right to select any available week within a certain season of the year. Therefore, if you own a summer season week you could pick any week, which falls within the</p>

<p>The multiple ownership of individual weeks brought with it the guarantee of reservations for those who wanted to ski in the area. It was an immediate success. By the 1970&#8242;s some faltering condominium projects in St. Thomas, Fort Lauderdale and Puerto Rico were converted over to vacation ownership and thereafter timesharing became a viable vacation alternative. Once the United States embraced the concept of vacation ownership it began to gain wide acceptance by the public. Sales jumped to over 50 million by the mid 1970&#8242;s and has climbed to more than 2 billion annually today. Vacation ownership has enjoyed substantial growth over the years with approximately 3.3 million timeshares sold since 1980. Currently there are over 5,000-vacation ownership resorts in over 75 countries around the world. Exchanging a vacation ownership week in one resort for that of another resort was introduced in 1974 and thereafter timesharing offered variety and flexibility in the vacation experience. Although there are many exchange companies available, which provide excellent service, the two major forces are Resort Condominiums International (RCI) which has approximately 3,250 member resorts and Interval International (II) with approximately 1,600 member resorts. Combined, these two companies provided over 1,600,000 exchanges last year. During a 30 year span, the industry has grown from small (15-20 unit ) hotel conversions to the high quality condominium resorts of today. The evolution of the industry from scattered entrepreneurs to well managed professional development companies has brought with it a noticeable change for the better. Definitive leaders have emerged and created standards and ethics for management, marketing and sales practices. One such organization is the American Resort Development Association (ARDA) who&#8217;s members are required to comply with the established &#8220;Code of Ethics.&#8221; The recent entrance into the marketplace by major hospitality chains such as Disney, Hilton, Ramada, and Marriott has greatly enhanced the quality and image of the industry. Vacation ownership resorts of today are luxurious, spacious and well located. By the advent of these stronger and more professional development and management companies along with the weeding out the less desirable developers and marketers, the industry is experiencing a noticeable swing from a historically negative to a very positive public image. One of the industries&#8217;s leading analysts (Ragatz and Associates) concluded that the majority of timeshare owners are very satisfied with their purchase and in fact, many own multiple weeks. The future of vacation ownership is very optimistic and has tremendous potential. What Is Vacation Ownership? Vacation Ownership &#8220;Timesharing&#8221; is the right to use specific weeks of a resort during a specific time period. Simply put, it is the pre-purchase of a vacation. It is important to understand that vacation ownership is a commodity, which is purchased to be enjoyed and used over the years. One should never purchase a timeshare with the intent of reselling it for a profit. Vacations are holidays for which we spend money to relax and rejuvenate; they are not investments. Ownership of a timeshare is very similar to ownership of a condominium except that your rights are limited to a certain week during the year. The form of ownership can be Deeded, Leased or a License. The License is somewhat different in that it is most commonly a membership in a club. Providing you are a member in good standing, you have the right to use the club and all it&#8217;s amenities. Be sure to read and understand all the terms and conditions of your club membership before you make the decision to buy. Most vacation ownership consists of either a deeded interest or a leased interest for a specific number of years. A Deeded interest is owned outright forever. It an absolute right, which can be sold, leased, or even willed to your heirs. Most timeshares, which exist today, are deeded ownership. The Leased interest is much like an apartment lease except right to use it is restricted to a specific week during the year. Upon the expiration of the lease term your right to use will generally terminate and return to the resort. With a leased interest you should know the terms and conditions of the lease prior to making the decision to buy. The time of your use can be either Fixed or Floating. Fixed time is a specific week during the year usually defined by a number. Generally the week will begin on a Friday, Saturday or Sunday and is given a number starting with the first week in January an run through the end of December. (Example &#8211; week 14 might be April 7 through April 13.) Floating time means you have the right to select any available week within a certain season of the year. Therefore, if you own a summer season week you could pick any week, which falls within the defined summer months. Each resort is different and you should ask if there are other benefits which are available to its owners. <p>Why is this such a problem getting out of a timeshare?  Below is an article from The NY Times that digs deep into the heart of the problem with timeshares.</p>
<p><strong>Timeshare trap: Some check in but can never get out</strong></p>
<p><strong>NEW YORK — </strong>Timeshare is not quite the investment that Patricia Uhler had hoped it would be. While companies like Wyndham Worldwide, Starwood Hotels &amp; Resorts Worldwide and Marriott International are doing great business around the world selling timeshares, Uhler has not been so fortunate.</p>
<p>Finding that she has less time and money for vacations than she expected, and with combined maintenance fees climbing to nearly ,200 a year, Uhler has sought to sell two weeks of timeshare that she had hoped would be a nice investment in prime resort real estate.</p>
<p>But in her six-month effort to sell a week at a resort in Myrtle Beach, South Carolina, and another week at a property near Walt Disney World in Orlando, Florida, Uhler, a mother of two, has encountered dubious brokers and the realization that most of her money is probably gone.</p>
<p>Buyers on the timeshare resale market are scarce, and experts say sellers are lucky to get out of their liability at any price. Timeshares are routinely offered for sale on the auction site eBay starting at 1 cent and no one is bidding.</p>
<p>The problem for many buyers like Uhler is that they believe timeshare is a slice of real estate, which they hope will increase in value. High-pressure, glitzy sales pitches can add to the confusion.</p>
<p>In fact, sometimes they have no ownership of the underlying property. With some arrangements, they are buying only the right to use what is typically a one- or two-bedroom apartment for a set amount of time each year. The industry is quick to point out that timeshare is a prepaid vacation, <strong>not an investment</strong>.</p>
<p>The slump in the American real estate market has made things even harder for people like Uhler, whose timeshares are in the United States. But the resale difficulties are worldwide.</p>
<p><strong>&#8220;Timeshare is a kind of stupid, complicated thing to get involved in,&#8221; said Annie Galvin, a Briton who owns a two-week timeshare at a development in Stratford-upon-Avon, England, the birthplace of William Shakespeare.</strong></p>
<p><strong>&#8220;We can&#8217;t sell it even if we find an idiot to buy it,&#8221; said Galvin, a substitute school teacher from Northwood, Middlesex, who bought the weeks for a total of about ,000 seven years ago. &#8220;We realize that we&#8217;ve lost our investment.&#8221;</strong></p>
<p>Wyndham Worldwide is the market leader in the United States, while Starwood, Marriott, and Walt Disney are also major players. Wyndham, Starwood and Marriott also have timeshare resorts outside of the United States, where the market is more fragmented.</p>
<p>Big lodging companies are counting on timeshare for growth, as the slowing American economy threatens to put an end to the boom in the hotel business. The Dow Jones U.S. Hotels index has fallen 32 percent since hitting a high in July.</p>
<p>Harry Taylor, secretary general of the Association of Timeshare Owners Committees, which is based in Birmingham, England, said reselling a timeshare was fraught with difficulty. &#8220;It&#8217;s a very poor marketplace,&#8221; he said.</p>
<p>Some people are even <strong>trying</strong> to give their timeshares away to get out of the annual maintenance fees, Taylor said. In some cases, a timeshare ends after a certain amount of time, while other timeshares are set up to end only if a people sell them.</p>
<p><strong>&#8220;When they&#8217;ve signed, they&#8217;ve signed it for perpetuity &#8211; you know, forever,&#8221; Taylor said. &#8220;If they die, it goes to the son. He&#8217;s got to pay it. There&#8217;s no exit policy.&#8221;</strong></p>
<p>The never-ending maintenance fees and the slowing U.S. economy have pushed more timeshare properties than usual onto the resale market, said Ed Hastry, who runs the Maryland Timeshare Owners Association in the United States. He said it was the worst market for timeshare sellers that he had seen since he started following the industry in 1988.</p>
<p><strong>The desperation of resellers like Galvin has opened the door to con men, looking to exploit the hopes for big money from the murky resale market.</strong></p>
<p><strong>&#8220;It is a huge area of fraud,&#8221; said Peter van der Mark, secretary general of the Organization for Timeshares in Europe, a trade group.</strong></p>
<p>The typical ruse involves a supposed timeshare broker, claiming to have found a buyer willing to pay a good price for the owner&#8217;s timeshare. The broker says he needs an <strong>upfront fee</strong> to arrange the transaction, which then never materializes.</p>
<p>The timeshare industry recognizes that a hobbled and fraud-ridden resale market could give the industry a bad reputation and eventually hit sales at new resorts.</p>
<p>The Organization for Timeshares in Europe said it was working with the authorities and had helped shut down more than 40 fraudulent timeshare brokers in Europe.</p>
<p>Howard Nussbaum, the president of the American Resort Development Association, likened the resale market to the used-car market of the 1960s, where unscrupulous salesmen could fleece naive consumers. He says the industry is working to create more regulation and standards for the market.</p>
<p>&#8220;The health of the resale market is very important to us,&#8221; Nussbaum said. &#8220;We have a dog in the fight.&#8221;</p>
<p>&#8220;I&#8217;ve talked to a lot of different companies that sell timeshare, but they all want money upfront,&#8221; Uhler said. &#8220;I didn&#8217;t realize the deceivingness of it.&#8221;</p>

<p>2)    Selling Timeshares</p>
<p>During the sales presentation, many salesmen will claim that the timeshare will appreciate in value over time. They may also make claims that if the client is not completely satisfied, the timeshare developer will buy it back for an attractive percentage of the fair market value. In reality, the timeshare developers do not buy back their timeshares. They may refer the timeshare owner to a third party resale company, who operates in a similar fashion to the scam rental agencies that collect fees to list the property, and then never follow through on the sale. We have also heard recently of clients who have listed with a resale company that claims to have a purchase offer from an actual client. The resale agent tells the client that they are required to pay the Mexican IVA taxes for the sale into an escrow account. In a matter of days, the client is supposed to receive their payment from the purchaser, and the taxes will be refunded. This is another form of timeshare scam because escrow accounts do not exist in Mexico. The resale agent takes the thousands of dollars, meant to be paid for taxes, and disappears.</p>

<p>3)    Cancelling Timeshares</p>
<p>Cancelling a timeshare is a complicated procedure that requires help from people with experience and knowledge. There are several new companies that claim to offer timeshare relief or cancellation for an upfront fee. They may send the client paperwork to transfer the title or complete the cancellation procedure. This paperwork never actually gets processed by the timeshare scam developer. When the client calls the resort, they are still in fact the owner of the timeshare, and they have lost money to the timeshare cancellation company in upfront fees.</p>

<p>Have you heard any of the following promises?</p>
<p>•    &#8221;Renting your timeshare is guaranteed.&#8221;</p>
<p>•    &#8221;The demand for rooms is greater than availability, so renting your timeshare will never be a problem.&#8221;</p>
<p>•    &#8221;the resort will handle the rental of your timeshare for you.&#8221;</p>
<p>•    &#8221;You can purchase a 2 bedroom lock-off suite, so that you can use 1 bedroom and rent the other bedroom to pay for your holiday.&#8221;</p>
<p>•    &#8221;You will receive several thousands of dollars per week for renting your timeshare.&#8221;</p>
<p>•    &#8221;The resort will send you a check for your profit from rental income.&#8221;</p>
<p>If you have been coerced into purchasing a timeshare based on these promises, you are a victim of timeshare fraud.</p>
<p>In order to make their timeshare sales, the salespeople in several resorts make fraudulent promises that you can rent your weeks for unrealistic prices, such as 00 US per week for a 1 bedroom suite.</p>
<p>Upon investigating online, many clients realize that the market value for their timeshares are often less than 0 US. If you visit sites such as EBay, non timeshare owners are able to rent weeks at the same resorts for a lower price than timeshare owners, so why would they pay exorbitant prices for something that they can purchase online for very little.</p>
<p>Sometimes full timeshare contracts that were purchased for thousands of dollars are for sale online for less that 0 US as many people just want to get rid of their timeshare obligations. In addition, there is an overwhelming amount of rental availability, making it virtually impossible to rent the timeshare as promised by the salespeople. The claim that rentals are guaranteed and there is a great demand for room rentals is another lie used to close timeshare sales.</p>
<p>To make matters worse, the resorts often rent weeks in their hotels for as low as 9 to entice people to come to the resort and purchase a timeshare. The resorts state that they will help people rent their timeshare weeks for inflated prices, but then they practically give away weeks to entice more potential consumers into buying. By doing this, they are creating a conflict of interest and continuing the vicious cycle of timeshare fraud.</p>
<p>Timeshare fraud victims are often persuaded into purchasing timeshares that are beyond their financial means with the intention to rent it out as a financial investment. They are persuaded into purchasing a plan when they have no prior intention to do so. Other times, clients are convinced that they should purchase more weeks or a larger unit than they need. They plan to use the rental income to pay for their yearly maintenance fees, pay off the purchase price quicker, or to make a profit. When it is not possible to rent the weeks, they realize that they have entered into a contract that was not what they were promised and they are unwillingly placed in a position of financial hardship. Without the rental income to be able to pay for the maintenance fees, special assessments and monthly payments, many people are forced to default on their contracts and are sent to collections, which can negatively affect their credit score. Timeshare fraud is a very serious issue, and can affect the client&#8217;s credit history for years, making it difficult for them to make other investments that could be beneficial for their financial situation.</p>
<p>I hope that if you are approached to buy a timeshare based on the rental income you will earn, that you will avoid the purchase. If what these salespeople promised was true, then millions of timeshare owners worldwide would be very rich by now; however, this is not the case. The only people getting rich are the fraudulent timeshare developers and salespeople who take advantage of people who trust in them and want to invest in a potential business opportunity for their future.</p>

Sometimes they will even show you a fax from their partner rental agency in the US stating that you are &#8220;guaranteed listings&#8221; and that rental suites at your property are in high demand by vacationers.</p>
<p>All of these false promises of an excellent return on investment entice vacationers to purchase timeshares. The resorts do not advise you that the companies they are referring you to will charge you an upfront fee to list your property.</p>
<p>Our clients have complained to us about companies such as Luxury Resort Management, Resort Rentals International, Dreams RSI or Regal Resales and Rentals, to whom they have paid several hundreds of dollars to list their properties on their websites. These types of companies promise to rent or sell timeshare properties for far more than the actual value. For example, they may offer to list your property for ,800 per week when the actual amount that it may rent for is less than 0. These unrealistic prices and assurance of rentals or sales lure clients into paying the upfront fee for their services. They often promise to send you the contract and draft listing before even processing the fee on your credit card. However, the administration fee is processed right away, and clients do not receive the draft listing for several weeks.</p>
<p>The rental agent contract usually states that their company will represent your property on their website. When the clients go to the rental agency´s website, there are no actual listings of timeshare units. Sometimes there is a generic listing of the property, but no details about the price or description of the unit. Potential renters or buyers have no information by which to even become interested in purchasing your weeks in your timeshare. The websites only have online forms for people to contact the agency if they wish to sell or rent their timeshare, not to rent their client´s timeshares.</p>
<p>Six months or a year later, the client´s properties have not sold or been rented, and they have never been contacted by the property management or realty company, or any of their representatives. The property management companies have already received their fee, so there is no incentive for them to follow through on their false promises. These companies are not in the business of renting or selling properties. Their profits are solely made by the listing fees that vulnerable timeshare owners pay to them. In short, not only have the timeshare purchasers been scammed by the resort, but also by the rental agencies who make deceitful guarantees that they will rent or sell their properties.</p>
<p>Property managers and realtors in North America normally do not charge upfront fees to represent you in a rental or sale. Listing on their website is part of their normal service, and is an expense incurred by the agency in order to do business. Payment is made on a commission basis once they are successful in renting or selling your property.</p>
<p>Avoid being scammed again by dishonest sales practices! When thinking of purchasing, renting, or canceling a timeshare, make sure that you do not pay any money upfront for administrative fees. You work hard for your money, and it is important that these companies don´t try to take that from you. Honest organizations will work hard to render their services so that they get paid accordingly.</p>

<p><strong>Should you upgrade or buy a new timeshare to get rid of your old one?</strong></p>
<p>Taking vacations is a luxury that people work hard to achieve. When people purchase a timeshare it is because they want to invest in their future enjoyment. If they experience problems with their timeshare (ie. lack of availability, fraudulent offers of discounts, poor customer service, etc.), it is very disheartening as they have invested a lot of their hard-earned money in good faith to the resort company. When victims of timeshare scam try to complain or to cancel their contracts, they are often talked into purchasing a new timeshare or upgrading their current one in hopes of rectifying their original problem. Numerous clients have contacted us to cancel, not just one timeshare contract, but 2, 3 or even 4 purchase agreements!</p>
<p>The following are just a few scenarios of how purchasers were persuaded into buying multiple timeshares due to their frustration with their original timeshare:</p>
<p>1.       When they first experienced problems with their timeshare, they contacted the timeshare company to complain. The timeshare company claimed that the problems they were experiencing (ie. lack of availability of their type of suites, lack of dates available, special offers promised during the sales presentation were invalid) were due to the fact that they had purchased a lower value timeshare package. The salespeople then continue to convince them to purchase an upgrade so that they can take full advantage of the resort, or have more flexibility in availability of suites and dates. They sign a new contract, which voids the initial contract, and agree to a new purchase price. Later they realize that the same problems they experienced previously are still occurring, even with their upgraded package. Not only had they lost their original investment, but they were also bound to a new contract with the dysfunctional company.</p>
<p>2.       On other occasions, clients regret their original purchase due to dissatisfaction with their timeshare or vacation plan. They may feel like they have been scammed into purchasing into a fraudulent agreement. While on another holiday they are approached to go to a timeshare presentation with a different resort company. The salesperson appeals to them by empathizing with their disappointment with their original timeshare. He offers them equity for their old timeshare and promises to take it over from them. The client is assured that they will no longer be responsible for their original timeshare if they purchase the timeshare with the new company. They sign a new contract and a trade-in equity agreement for the old timeshare. Regrettably, later they find out that their old timeshare was never taken over, and they are now responsible for maintaining two timeshares. We have heard of people who have had this situation several times, leaving them with up to 5 active timeshares and all the fees that go along with these purchases.</p>
<p>3.       Another variation of timeshare scam is when the new timeshare company promises that they can sell the client&#8217;s old timeshare, often for greater than the purchase price of the timeshare with the new company. They are verbally advised that the sale is guaranteed if they purchase the new timeshare; however, this information is not included in the written contract for the new timeshare.  The clients are later referred to a resale agency who charges an additional listing fee. The resale agencies will list the old timeshare on their website, but don&#8217;t actually guarantee timeshare sales, and in the majority of cases the clients are not able to sell their original timeshare. The clients are left with multiple timeshare contracts and responsibilities, and the loss of the listing fee to the resale agency.</p>
<p>The solution to a non-functional timeshare is not to purchase another timeshare or upgrade the existing one. It is very likely that this will result in being stuck with multiple fraudulent timeshare plans and a very costly financial burden.</p>
<p>The best option to resolve a timeshare scam situation is to cancel your contract and get your money reimbursed. This way your original investment is recovered so that you can spend your money as you desire.
