On October 22, 2008, Parliament adopted a new directive to help protect consumers in respect of certain areas of the timeshare industry and how the timeshare is sold. They will highlight the key areas that both inform and protect consumers and strengthen confidence in the choice of investing part time in the future.
The main reasons for timeshare seem lost to a fog of disinformation. These gaps and omissions of the Timeshare Directive in 1994 has quickly become evident and then been shamelessly exploited by companies working around the content of directive.
The problems for the front of the timeshare industry and consumers are lack of pre-contractual information in detail, so that consumers could not make an informed decision. From next year, new contracts will include information on the rights of the purchaser to terminate the contract at any time during their ownership and give details of the legal and financial consequences of this action.
This will help avoid problems like that happened Ms. Brown. Her husband died and she tried to relieve themselves of their part-time only to learn that the contract they signed him would to do so. She was obliged to continue paying annual maintenance fees which all have been rising steadily. Unfortunate and unfair as it is, the timeshare owners are often trapped in their property until the end of their days.
The new rules ensure that companies must provide a disclosure document detailing all the features, amenities, and rules of the timeshare, including an explanation of the consequences of non-payment of annual taxes. In the past, have been seized timeshare for non-payment, while today the defaulting customer is more likely to be taken to court to enforce such payments.
The commitment to increase annually All management costs could be avoided and timeshare owners could just abandon their "customary law" without fear of harassment and threats to management of any unpaid fees.
The new directive will also exhibit the up-front collection of any right of resale companies dishonest. Any fees for the sale of a seller to part time from now will be payable upon completion of the sale. This should put an end to the fraudulent resale of predators and allow people to really alleviate their timeshare.
Is this new regulation will be a way back to the true meaning of timeshare? Then people could really start enjoying the "notion of style luxury living at affordable prices' once again as they do for the USA.
The application of legislation to protect consumers part time was very unsatisfactory, but the directive is not expected to become law throughout Europe until February 23, 2011, although some Member States may have to be before that (The United Kingdom hoped would be adopted by June 2010).
I hope that this law will be successful and help to clean the tarnished reputation of the timeshare industry in Europe.
I was told that you can not legally sell a timeshare – Is this true?
They said that the name of the original purchaser would about it and it would therefore be required to pay if the "new owner" does not pay the annual maintenance costs.
Depends on your agreement. Read the contract.
